Article L5125-33 of the French Public Health Code

Electronic commerce in medicinal products means the economic activity whereby the pharmacist offers or carries out the retail sale and dispensing of medicinal products for human use to the public by electronic means and, to this end, provides online health information.

The e-commerce activity is carried out within a pharmacy open to the public which holds the licence referred to in articles L. 5125-10 or L. 5125-18. It is implemented from the website of a pharmacy under the conditions set out in this article.

In compliance with article L. 4211-1, the creation and operation of an e-commerce website for the dispensing and retail sale of medicinal products is reserved exclusively for the pharmacist holding a pharmacy or the pharmacist managing a mutual or community pharmacy.

The pharmacists who have a website are responsible for the content published and the conditions under which the electronic trading of medicinal products is carried out, in particular compliance with good practice in the dispensing of medicinal products as set out in article L. 5121-5 and the technical rules applicable to websites for the online sale of medicinal products as set out in article L. 5125-39.

Assistant pharmacists who have been delegated by one of the pharmacists mentioned in the third paragraph may participate in the operation of the pharmacy’s website.

Pharmacists replacing pharmacy owners or pharmacy managers following the death of the pharmacy owner may operate the pharmacy website previously created by the pharmacy owner.

On entend par commerce électronique de médicaments l’activité économique par laquelle le pharmacien propose ou assure à distance et par voie électronique la vente au détail et la dispensation au public des médicaments à usage humain et, à cet effet, fournit des informations de santé en ligne.

L’activité de commerce électronique est réalisée au sein d’une officine ouverte au public titulaire de la licence mentionnée aux articles L. 5125-10 ou L. 5125-18. Elle est mise en œuvre à partir du site internet d’une officine de pharmacie dans les conditions prévues au présent article.

Dans le respect de l’article L. 4211-1, sont exclusivement réservées au pharmacien titulaire d’une officine ou au pharmacien gérant d’une pharmacie mutualiste ou de secours minière la création et l’exploitation du site internet de commerce électronique de dispensation et de vente de médicaments au détail.

Les pharmaciens disposant d’un site internet sont responsables des contenus édités et des conditions de mise en œuvre de l’activité de commerce électronique de médicaments, notamment du respect des bonnes pratiques de dispensation des médicaments prévues à l’article L. 5121-5 et des règles techniques applicables aux sites internet de vente en ligne de médicaments prévues à l’article L. 5125-39.

Les pharmaciens adjoints ayant reçu délégation de l’un des pharmaciens mentionnés au troisième alinéa peuvent participer à l’exploitation du site internet de l’officine de pharmacie.

Les pharmaciens remplaçant de titulaires d’officine ou gérants d’officine après décès du titulaire peuvent exploiter le site internet de l’officine créé antérieurement par le titulaire de l’officine.
