Article L513-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The persecution or threat of persecution taken into account in the recognition of refugee status and the serious harm or threat of serious harm that may give rise to the benefit of subsidiary protection may be caused by the State authorities, parties or organisations controlling the State or a substantial part of the territory of the State, or by non-State actors in cases where the authorities defined in the first paragraph of Article L. 513-3 refuse or are unable to offer protection.

Les persécutions ou menaces de persécutions prises en compte dans la reconnaissance de la qualité de réfugié et les atteintes graves ou menaces d’atteintes graves pouvant donner lieu au bénéfice de la protection subsidiaire peuvent être le fait des autorités de l’Etat, de partis ou d’organisations qui contrôlent l’Etat ou une partie substantielle du territoire de l’Etat, ou d’acteurs non étatiques dans les cas où les autorités définies au premier alinéa de l’article L. 513-3 refusent ou ne sont pas en mesure d’offrir une protection.
