Article L5134-70 of the French Labour Code

By way of derogation from the provisions relating to termination before the end of the fixed-term employment contract set out in article L. 1243-2, the Employment Initiative Contract may be terminated before its end, at the employee’s initiative, when the purpose of the termination is to enable the employee:

1° To be taken on under a fixed-term contract of at least six months ;

2° To be taken on under an open-ended contract;

3° To follow a training course leading to a qualification as provided for in article L. 6314-1.

Par dérogation aux dispositions relatives à la rupture avant le terme du contrat de travail à durée déterminée prévues à l’article L. 1243-2, le contrat initiative emploi peut être rompu avant son terme, à l’initiative du salarié, lorsque la rupture a pour objet de lui permettre :

1° D’être embauché par un contrat à durée déterminée d’au moins six mois ;

2° D’être embauché par un contrat à durée indéterminée ;

3° De suivre une formation conduisant à une qualification telle que prévue à l’article L. 6314-1.
