Article L5138-2 of the French Public Health Code

I.-“Raw materials for pharmaceutical use” means all the constituents of medicinal products within the meaning of Article L. 5111-1, i.e. :

1° The active substance or substances. An active substance is any substance or mixture of substances intended to be used for the manufacture of a medicinal product and which, when used for its production, becomes an active component of this medicinal product exerting a pharmacological, immunological or metabolic action with a view to restoring, correcting or modifying physiological functions, or establishing a medical diagnosis;

2° The excipient(s). An excipient is any component of a medicinal product other than an active substance and packaging materials.

II – Pharmaceutical use is presumed for these materials when they are sold to :

1° A pharmaceutical establishment mentioned in article L. 5124-1 or article L. 5142-1 ;

2° A pharmacy for internal use ;

3° A pharmacy ;

4° A doctor, a veterinarian or a person authorised to prepare self-vaccines for veterinary use mentioned in article L. 5142-1-1 or veterinary medicinal products mentioned in article L. 5142-1-2 ;

5° An establishment or organisation mentioned in article L. 5142-1-1 or article L. 5142-1-2.

This is not the case when the person selling these materials provides proof of a different use by producing a certificate from the purchaser.

III – In order to establish, or not, the pharmaceutical use of one of the raw materials mentioned in I and sold to a person other than those listed in II, the seller must be able to justify the use of these raw materials. To this end, he may ask the purchaser for a certificate attesting to their intended use.

IV -The manufacture of a raw material for pharmaceutical use means the complete or partial manufacture of this raw material as well as the various processes of division or packaging prior to its incorporation into a medicinal product and storage, with a view to its sale.

V.-Distribution of a raw material for pharmaceutical use means the activities of purchasing, selling, repackaging, relabelling and storage.

Article L5138-2

I.-On entend par matières premières à usage pharmaceutique tous les composants des médicaments au sens de l’article L. 5111-1, c’est-à-dire :

1° La ou les substances actives. Est une substance active toute substance ou tout mélange de substances destiné à être utilisé pour la fabrication d’un médicament et qui, lorsqu’utilisé pour sa production, devient un composant actif de ce médicament exerçant une action pharmacologique, immunologique ou métabolique en vue de restaurer, corriger ou modifier des fonctions physiologiques, ou d’établir un diagnostic médical ;

2° Le ou les excipients. Est un excipient tout composant d’un médicament autre qu’une substance active et que les matériaux d’emballage.

II.-L’usage pharmaceutique est présumé pour ces matières lorsqu’elles sont cédées à :

1° Un établissement pharmaceutique mentionné à l’article L. 5124-1 ou à l’article L. 5142-1 ;

2° Une pharmacie à usage intérieur ;

3° Une officine de pharmacie ;

4° Un médecin, un vétérinaire ou une personne autorisée pour la préparation des autovaccins à usage vétérinaire mentionnée à l’article L. 5142-1-1 ou des médicaments vétérinaires mentionnés à l’article L. 5142-1-2 ;

5° Un établissement ou organisme mentionné à l’article L. 5142-1-1 ou à l’article L. 5142-1-2.

Il en va autrement lorsque la personne qui cède ces matières justifie d’une autre destination par la production d’une attestation émanant de l’acheteur.

III.-En vue d’établir, ou non, l’usage pharmaceutique d’une des matières premières mentionnées au I et cédées à une personne autre que celles énumérées au II, le vendeur doit pouvoir justifier de la destination de ces matières premières. A cette fin, il peut demander à l’acheteur une attestation justifiant de leur destination.

IV.-On entend par fabrication d’une matière première à usage pharmaceutique la fabrication complète ou partielle de cette matière première ainsi que les divers procédés de division ou de conditionnement préalables à son incorporation dans un médicament et le stockage, en vue de sa vente.

V.-On entend par distribution d’une matière première à usage pharmaceutique les activités d’achat, de vente, de reconditionnement, de réétiquetage et de stockage.
