Without prejudice to the provisions of Articles 94 and 95 of Regulation (EU) 2019/6 of 11 December 2018, specific obligations shall be laid down by regulation for the import, manufacture, acquisition, possession, sale or transfer free of charge of substances which are not veterinary medicinal products but which may be used in their manufacture:
a) Virulent substances and products of microbial origin intended for the diagnosis, prevention and treatment of animal diseases;
b) Substances of organic origin intended for the same purposes, with the exception of those containing only chemically known principles;
c) Substances with anabolic, anticatabolic or beta-agonist activity;
d) Poisonous substances;
e) Pharmacologically active substances likely to remain as toxic or dangerous residues in foodstuffs of animal origin and for which a maximum residue limit is laid down in Table 1 of the Annex to Commission Regulation (EU) No 37/2010 of 22 December 2009 on pharmacologically active substances and their classification as regards maximum residue limits in foodstuffs of animal origin;
f) Products whose effects are likely to be the cause of a breach of fraud legislation;
g) Products likely to hinder the health control of foodstuffs from animals to which they have been administered.
A joint order by the Ministers of Agriculture and Health sets the list of products mentioned in f and g.
These substances may not be supplied as they are to the farmers or agricultural groups referred to in article L. 5143-6, or held or possessed by these farmers or groups, unless they are intended to be used for authorised agricultural or plant health purposes.
A decree issued after consultation with the Agence nationale chargée de la sécurité sanitaire de l’alimentation, de l’environnement et du travail (National Agency for Food, Environmental and Occupational Health Safety) sets the list and specific conditions for issuing substances or categories of substances that may be used to manufacture veterinary medicinal products subject to a withdrawal period.
