Article L5145-2-2 of the French Public Health Code

Without prejudice to any criminal proceedings that may be brought, where a veterinary medicinal product is placed on the market or used without having obtained the prior authorisation or registration required by the provisions of Regulation (EU) 2019/6 of 11 December 2018 or this Title, or is placed on the market or used in disregard of those provisions, the Agency may suspend, the testing, manufacture, preparation, import, use, export, wholesale distribution, packaging, placing on the market free of charge or against payment, holding with a view to sale or free distribution, advertising, prescription, dispensing, use or administration of this veterinary medicinal product, until the medicinal product has been brought into compliance with the laws and regulations in force.

Article L5145-2-2

Sans préjudice des poursuites pénales qui peuvent être exercées, lorsqu’un médicament vétérinaire est mis sur le marché ou utilisé sans avoir obtenu l’autorisation ou l’enregistrement préalable exigé par les dispositions du règlement (UE) 2019/6 du 11 décembre 2018 ou du présent titre, ou est mis sur le marché ou utilisé en méconnaissance de ces dispositions, l’agence peut suspendre, jusqu’à la mise en conformité du médicament au regard de la législation et de la réglementation en vigueur, les essais, la fabrication, la préparation, l’importation, l’exploitation, l’exportation, la distribution en gros, le conditionnement, la mise sur le marché à titre gratuit ou onéreux, la détention en vue de la vente ou de la distribution à titre gratuit, la publicité, la prescription, la délivrance, l’utilisation ou l’administration de ce médicament vétérinaire.
