Article L5145-4 of the French Public Health Code

In the cases provided for in articles L. 5145-2-1 and L. 5145-2-2 as well as in the case of suspension or withdrawal of a marketing authorisation or registration of a veterinary medicinal product, the Agency may order the person responsible for placing the product on the market to withdraw the medicinal product from any place where it is found, or to destroy it when the medicinal product presents a danger to public or animal health or to the environment, or order the dissemination of warnings or precautions for use. These measures are the responsibility of this person.

Measures to withdraw or destroy a veterinary medicinal product may be limited to certain production batches.

Any manufacturer, importer or distributor who has acquired or sold withdrawn or destroyed batches and who is aware of the decision is required to inform those who have supplied the goods and those to whom they have sold them.

Dans les cas prévus aux articles L. 5145-2-1 et L. 5145-2-2 ainsi que dans le cas d’une suspension ou d’un retrait d’autorisation de mise sur le marché ou d’enregistrement d’un médicament vétérinaire, l’agence peut enjoindre à la personne responsable de la mise sur le marché de procéder au retrait du médicament en tout lieu où il se trouve, ou à sa destruction lorsque le médicament présente un danger pour la santé publique ou animale ou pour l’environnement, ou ordonner la diffusion de mises en garde ou de précautions d’emploi. Ces mesures sont à la charge de cette personne.

Les mesures de retrait ou de destruction d’un médicament vétérinaire peuvent être limitées à certains lots de fabrication.

Chaque fabricant, importateur, distributeur ayant acquis ou cédé des lots retirés ou détruits et ayant connaissance de la décision, est tenu d’en informer ceux qui lui ont fourni la marchandise et ceux à qui il l’a cédée.
