Article L521-2 of the French Intellectual Property Code

The civil action for infringement shall be brought by the owner of the design.

However, the beneficiary of an exclusive right of exploitation may, unless otherwise stipulated in the licence agreement, bring the action for infringement if, after formal notice, the owner of the design fails to bring such action.

Any party to a licence agreement is entitled to intervene in infringement proceedings brought by another party in order to obtain compensation for the prejudice specific to that party.

L’action civile en contrefaçon est exercée par le propriétaire du dessin ou modèle.

Toutefois, le bénéficiaire d’un droit exclusif d’exploitation peut, sauf stipulation contraire du contrat de licence, exercer l’action en contrefaçon si, après mise en demeure, le propriétaire du dessin ou modèle n’exerce pas cette action.

Toute partie à un contrat de licence est recevable à intervenir dans l’instance en contrefaçon engagée par une autre partie afin d’obtenir la réparation du préjudice qui lui est propre.
