Article L5213-5 of the French Public Health Code

The Agence nationale de sécurité du médicament et des produits de santé and the administrative authority referred to in II of Article L. 5211-2, within their respective areas of competence, may, under the conditions set out in Article L. 5312-4-1, give formal notice to the person concerned to withdraw the advertising, to present their observations and to rectify the situation, if necessary by imposing a fine on the formal notice. They may order a ban on the advertising, after the company concerned has been given formal notice.

Article L5213-5

L’Agence nationale de sécurité du médicament et des produits de santé et l’autorité administrative mentionnée au II de l’article L. 5211-2, dans leurs champs de compétence respectifs, peuvent, dans les conditions fixées à l’article L. 5312-4-1, mettre en demeure la personne concernée de retirer la publicité, de présenter ses observations et de régulariser la situation, au besoin en assortissant cette mise en demeure d’une astreinte. Elles peuvent prononcer une interdiction de la publicité, après que l’entreprise concernée a été mise en demeure.
