Article L522-14 of the French Monetary and Financial Code

Payment institutions are required to comply with management standards designed to ensure their solvency and the balance of their financial structure. They must also have an adequate internal control system enabling them in particular to measure the risks and profitability of their activities, including when they entrust essential or important operational functions or other tasks to third parties.

They must maintain an adequate level of own funds.

The conditions for application of this article and, in particular, the methods of calculation relating to the capital requirements applicable to institutions which provide one or more of the services mentioned in 1° to 6° of II of article L. 314-1 are laid down by regulation.

Les établissements de paiement sont tenus de respecter des normes de gestion destinées à garantir leur solvabilité ainsi que l’équilibre de leur structure financière. Ils doivent également disposer d’un dispositif adéquat de contrôle interne leur permettant notamment de mesurer les risques et la rentabilité de leurs activités, y compris lorsqu’ils confient à des tiers des fonctions ou autres tâches opérationnelles essentielles ou importantes.

Ils doivent respecter un niveau de fonds propres adéquat.

Les conditions d’application du présent article et, en particulier, les modalités de calcul afférentes aux exigences en fonds propres applicables aux établissements qui fournissent un ou plusieurs services mentionnés aux 1° à 6° du II de l’article L. 314-1 sont fixées par voie réglementaire.
