Article L522-37-4 of the French Commercial code

The pledge of goods represented by a warehousing receipt constituted by the holder of this title is established with regard to third parties as well as with regard to the contracting parties by its entry in the register mentioned in the first paragraph of Article L. 522-37-2 under the conditions laid down by decree in the Conseil d’Etat.

No security other than the pledge created pursuant to the first paragraph of this article may be granted over goods represented by a storage receipt, on pain of its creation being unenforceable. The realisation and judicial allocation of the pledge of goods represented by a storage receipt are governed by Articles 2346 to 2348 of the Civil Code.

A decree of the Conseil d’Etat shall define the conditions for registration of the pledge and the operating procedures of the register.

Le gage des marchandises représentées par un reçu d’entreposage constitué par le titulaire de ce titre se constate à l’égard des tiers comme à l’égard des parties contractantes par son inscription au registre mentionné au premier alinéa de l’article L. 522-37-2 dans les conditions fixées par décret en Conseil d’Etat.

Il ne peut être consenti aucune sûreté autre que le gage constitué en application du premier alinéa du présent article sur des marchandises représentées par un reçu d’entreposage, à peine d’inopposabilité de sa constitution. La réalisation et l’attribution judiciaire du gage de marchandises représentées par un reçu d’entreposage sont régies par les articles 2346 à 2348 du code civil.
