I. – Payment service providers may use the services of one or more agents to carry out payment service activities on their behalf, within the limits of their authorisation.
Agents may promote the services provided by payment service providers and be authorised to canvass customers on their behalf under the conditions laid down in Chapter I of Title IV of Book III of this Code.
All agents act on the basis of a mandate given by a payment service provider. Agents are required to inform users of their status as agents when they come into contact with them. An agent may receive mandates from several payment service providers.
II. – Payment service providers other than account information service providers mentioned in II of Article L. 522-1 shall register the agents they intend to use with the Autorité de contrôle prudentiel et de résolution. To this end, they shall provide the Autorité with information enabling it to verify that these agents meet the conditions required by this chapter. A payment service provider may call upon another payment service provider to provide the information necessary for the registration of agents.
Where an agent no longer meets the conditions for registration, it is the responsibility of the payment service provider to inform the authority with which the agent was registered.
III. – The Autorité de contrôle prudentiel et de résolution may refuse to register an agent if, after verification, it is not satisfied with the information provided.
IV. – The conditions for application of this article are defined by an order of the Minister responsible for the economy.
