I. – When a payment service provider, other than a credit institution, with its registered office in mainland France, Guadeloupe, French Guiana, Martinique, Reunion Island, Mayotte or Saint-Martin, wishes to use an agent to provide payment services in another Member State of the European Union or party to the Agreement on the European Economic Area, the procedures set out in I of Article L. 522-13 shall apply.
II. – When a payment service provider, other than a credit institution authorised in another Member State of the European Union or party to the Agreement on the European Economic Area, wishes to use an agent to provide payment services in mainland France, Guadeloupe, French Guiana, Martinique, La Réunion, Mayotte or Saint-Martin, the procedures set out in II of Article L. 522-13 are applicable.
III. – When a credit institution authorised in another Member State of the European Union or party to the Agreement on the European Economic Area wishes to provide payment services in mainland France, Guadeloupe, French Guiana, Martinique, Reunion Island, Mayotte or Saint-Martin through an agent, it shall inform the Autorité de contrôle prudentiel et de résolution of its plans and send it prior information of a nature determined by order of the Minister responsible for the economy. The provisions of the second paragraph of 1° of II of Article L. 522-13 apply.
