Article L5232-3 of the French Public Health Code

Service providers and distributors of equipment, including medical devices or their accessories, designed to help people who are ill or have an incapacity or disability within the meaning of article L. 114 of the French Social Action and Family Code to return to their own homes and become independent, must have staff who hold a diploma, validated professional experience or equivalent attesting to training in the provision of this equipment or these services and who comply with the conditions of practice and rules of good practice.

Service providers and equipment distributors organise continuing training and access to lifelong continuing professional development for their staff.

An order by the Minister for Health sets the list of equipment and services mentioned in the first paragraph.

A decree shall specify the other procedures for applying this article.

Article L5232-3

Les prestataires de service et les distributeurs de matériels, y compris les dispositifs médicaux ou leurs accessoires, destinés à favoriser le retour à domicile et l’autonomie des personnes malades ou présentant une incapacité ou un handicap au sens de l’article L. 114 du code de l’action sociale et des familles, doivent disposer de personnels titulaires d’un diplôme, d’une validation d’acquis d’expérience professionnelle ou d’une équivalence attestant d’une formation à la délivrance de ces matériels ou de ces services et respecter des conditions d’exercice et règles de bonne pratique.

Les prestataires de service et les distributeurs de matériels organisent la formation continue et l’accès à la formation professionnelle continue tout au long de la vie de leurs personnels.

Un arrêté du ministre chargé de la santé fixe la liste des matériels et services mentionnés au premier alinéa.

Un décret précise les autres modalités d’application du présent article.
