Article L531-23 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a decision is made on the application made by each of the parents under the conditions set out in article L. 521-3, the decision granting the most extensive protection is deemed to have been made for the benefit of the children as well. This decision is not enforceable against children who establish that the person who made the application was not entitled to do so.

Lorsqu’il est statué sur la demande de chacun des parents présentée dans les conditions prévues à l’article L. 521-3, la décision accordant la protection la plus étendue est réputée prise également au bénéfice des enfants. Cette décision n’est pas opposable aux enfants qui établissent que la personne qui a présenté la demande n’était pas en droit de le faire.
