Article L5312-3 of the French Public Health Code

In the cases referred to in Articles L. 5312-1 and L. 5312-2, and in the event of suspension or withdrawal of authorisation or registration of a product or group of products referred to in Article L. 5311-1, the Agency may order the natural or legal person responsible for placing the product on the market, putting it into service, making it available on the market or using it to withdraw the product or group of products from any place where it is found, to destroy it when this is the only way of putting an end to the danger, and to order the dissemination of warnings or precautions for use. These measures are the responsibility of the person concerned.

Where appropriate, measures to suspend, ban, withdraw or destroy a product may be limited to certain production batches.

Any manufacturer, importer, transporter, wholesale or retail distributor who has acquired or disposed of the batches concerned and who is aware of the decision is required to inform those who have supplied the goods and those to whom they have disposed of them.

Dans les cas mentionnés aux articles L. 5312-1 et L. 5312-2, ainsi que dans le cas d’une suspension ou d’un retrait d’autorisation ou d’enregistrement d’un produit ou groupe de produits mentionné à l’article L. 5311-1, l’agence peut enjoindre la personne physique ou morale responsable de la mise sur le marché, de la mise en service, de la mise à disposition sur le marché ou de l’utilisation de procéder au retrait du produit ou groupe de produits en tout lieu où il se trouve, à sa destruction lorsque celle-ci constitue le seul moyen de faire cesser le danger, et ordonner la diffusion de mises en garde ou de précautions d’emploi. Ces mesures sont à la charge de cette personne.

Le cas échéant, les mesures de suspension, d’interdiction, de retrait ou de destruction d’un produit peuvent être limitées à certains lots de fabrication.

Chaque fabricant, importateur, transporteur, distributeur en gros ou au détail ayant acquis ou cédé des lots concernés et ayant connaissance de la décision est tenu d’en informer ceux qui lui ont fourni la marchandise et ceux à qui il l’a cédée.
