Article L5313-1 of the French Public Health Code

The Agency shall appoint inspectors from among its staff to monitor the application of laws and regulations, in particular the application of the rules of good practice defined by decision of the Agence nationale de sécurité du médicament et des produits de santé or by order of the Minister for Health pursuant to this code, as well as the common specifications or standards concerning the devices mentioned in Article 1 of Regulation (EU) 2017/745, transposing the harmonised European standards whose references have been published in the Journal officiel de la République française, relating to the activities and products mentioned in Article L. 5311-1. They are also responsible for collecting the information required to carry out the Agency’s tasks as defined in Articles L. 5311-1 and L. 5311-2, as well as the inspections mentioned in Article L. 5311-2.

The provisions of articles L. 1421-2, L. 1421-3, L. 5127-2 and L. 5425-1 are applicable to the performance of this task. Inspections are carried out in accordance with the best practices defined by the Director General of the Agency.

They may be assisted by experts appointed by the Director General of the Agency and may carry out joint inspections with agents belonging to the departments of the State and its public establishments.

Article L5313-1

L’agence désigne, parmi ses agents, des inspecteurs qui contrôlent l’application des lois et règlements, notamment l’application des règles de bonnes pratiques définies par décision de l’Agence nationale de sécurité du médicament et des produits de santé ou par arrêté du ministre chargé de la santé en application du présent code, ainsi que des spécifications communes ou des normes concernant les dispositifs mentionnés à l’article premier du règlement (UE) 2017/745, transposant les normes européennes harmonisées dont les références ont été publiées au Journal officiel de la République française, relatifs aux activités et aux produits mentionnés à l’article L. 5311-1. Ils sont également chargés de procéder au recueil des informations nécessaires à l’exercice des missions de l’agence définies aux articles L. 5311-1 et L. 5311-2, ainsi qu’aux contrôles mentionnés à l’article L. 5311-2.

Les dispositions des articles L. 1421-2, L. 1421-3, L. 5127-2 et L. 5425-1 sont applicables à l’exercice de cette mission. Les inspections sont réalisées conformément aux bonnes pratiques définies par le directeur général de l’agence.

Ils peuvent être assistés par des experts désignés par le directeur général de l’agence et procéder à des inspections conjointes avec des agents appartenant aux services de l’Etat et de ses établissements publics.
