The Autorité des marchés financiers may, at the request of the European Securities and Markets Authority:
1° Prohibit the marketing, in the European Union, of units or shares of AIFs managed by managers established in third countries or of third-country AIFs managed by managers established in the European Union without the authorisation required in Article L. 532-30 or without the notification referred to in Articles L. 214-24-1 and L. 214-24-2 or without being authorised to do so by the Member States concerned in accordance with Article L. 214-24-1 ;
2° Impose restrictions on AIFM established in a third country with regard to the management of an AIF in the event of excessive risk concentration on a specific market on a cross-border basis;
3° Impose restrictions on AIFM established in a third country with regard to the management of an AIF where its activities are likely to constitute a significant source of counterparty risk for a credit institution or other systemically important institution.
