Article L532-47 of the French Monetary and Financial Code

In this section :

1° “Third-country firm” means a firm which, if its head office or registered office were situated in a Member State of the European Union, would be either a credit institution providing investment services or engaging in investment activities, or an investment firm;

2° “Home State” means the State in which the third-country firm has its registered office or, if, under its national law, it has no registered office, the State in which its effective management is exercised.

Dans la présente section :

1° L’expression : “ entreprise de pays tiers ” désigne une entreprise qui, si son administration centrale ou son siège social étaient situés dans un Etat membre de l’Union européenne, serait soit un établissement de crédit fournissant des services d’investissement ou exerçant des activités d’investissement, soit une entreprise d’investissement ;

2° L’expression : ” Etat d’origine ” désigne l’Etat dans lequel l’entreprise de pays tiers a son siège social ou si, conformément à son droit national, elle en est dépourvue, l’Etat dans lequel s’exerce sa direction effective.
