Article L5421-2 of the French Public Health Code

I. – It is an offence to market, broker or distribute, whether free of charge or for a consideration, wholesale or retail, a proprietary medicinal product, any other medicinal product manufactured industrially or according to a method involving an industrial process, as well as any generator, kit or precursor as defined respectively in 8°, 9° and 10° of article L. 5121-1, without a marketing authorisation, a temporary use authorisation, an authorisation referred to in article L. 5121-9-1 or without an import authorisation, or whose authorisation has been refused, suspended, withdrawn or lapsed, is punishable by five years’ imprisonment and a fine of 375,000 euros.

II. – The same penalties apply to the production, commissioning, distribution or commissioning of advertising for a proprietary medicinal product, any other medicinal product manufactured industrially or according to a method involving an industrial process, as well as for any generator, kit or precursor as defined respectively in 8°, 9° and 10° of article L. 5121-1, which have not been the subject of a marketing authorisation, a temporary use authorisation, an authorisation mentioned in article L. 5121-9-1 or an import authorisation, or whose authorisation has been refused, suspended, withdrawn or lapsed.

III. – The penalties provided for in I and II are increased to seven years’ imprisonment and a fine of €750,000 when the offences provided for in the same paragraphs:

1° Are of such a nature as to entail a serious risk to human health;

2° Have been committed as part of an organised gang;

3° Have been committed on a telecommunications network intended for a non-specified public;

4° Have been committed by pharmaceutical establishments authorised in accordance with article L. 5124-3, brokers declared in accordance with article L. 5124-20, dispensing pharmacists holding the licence mentioned in article L. 5125-4 and pharmacies for internal use mentioned in article L. 5126-5 of the same code.

Article L5421-2

I. – Le fait de commercialiser, de réaliser l’activité de courtage ou de distribuer à titre gratuit ou onéreux, en gros ou au détail, une spécialité pharmaceutique, tout autre médicament fabriqué industriellement ou selon une méthode dans laquelle intervient un processus industriel, ainsi que tout générateur, trousse ou précurseur tels que définis respectivement aux 8°, 9° et 10° de l’article L. 5121-1, sans une autorisation de mise sur le marché, une autorisation temporaire d’utilisation, une autorisation mentionnée à l’article L. 5121-9-1 ou sans une autorisation d’importation, ou dont l’autorisation est refusée, suspendue, retirée ou devenue caduque, est puni de cinq ans d’emprisonnement et de 375 000 euros d’amende.

II. – Est puni des mêmes peines le fait de réaliser, faire réaliser, diffuser ou faire diffuser une publicité sur une spécialité pharmaceutique, tout autre médicament fabriqué industriellement ou selon une méthode dans laquelle intervient un processus industriel, ainsi que sur tout générateur, trousse ou précurseur tels que définis respectivement aux 8°, 9° et 10° de l’article L. 5121-1, qui n’ont pas fait l’objet d’une autorisation de mise sur le marché, d’une autorisation temporaire d’utilisation, d’une autorisation mentionnée à l’article L. 5121-9-1 ou d’une autorisation d’importation, ou dont l’autorisation est refusée, suspendue, retirée ou devenue caduque.

III. – Les peines prévues aux I et II sont portées à sept ans d’emprisonnement et 750 000 € d’amende, lorsque les délits prévus aux mêmes paragraphes :

1° Sont de nature à entraîner un risque grave pour la santé de l’homme ;

2° Ont été commis en bande organisée ;

3° Ont été commis sur un réseau de télécommunication à destination d’un public non déterminé ;

4° Ont été commis par des établissements pharmaceutiques autorisés conformément à l’article L. 5124-3, des courtiers déclarés conformément à l’article L. 5124-20, des pharmaciens d’officine titulaires de la licence mentionnée à l’article L. 5125-4 et des pharmacies à usage intérieur mentionnés à l’article L. 5126-5 du même code.
