Article L5422-20 of the French Labour Code

The measures for implementing the provisions of this chapter, with the exception of the articles of this section, 5° of article L. 5422-9, articles L. 5422-10, L. 5422-14 to L. 5422-16 and article L. 5422-25, are the subject of agreements concluded between representative employers’ and employees’ organisations.

These agreements are approved under the conditions defined by this section.

In the absence of an agreement or its approval, the implementing measures are determined by decree in the Conseil d’Etat.

Les mesures d’application des dispositions du présent chapitre, à l’exception des articles de la présente section, du 5° de l’article L. 5422-9, des articles L. 5422-10, L. 5422-14 à L. 5422-16 et de l’article L. 5422-25, font l’objet d’accords conclus entre les organisations représentatives d’employeurs et de salariés.

Ces accords sont agréés dans les conditions définies par la présente section.

En l’absence d’accord ou d’agrément de celui-ci, les mesures d’application sont déterminées par décret en Conseil d’Etat.
