Article L5424-1 of the French Labour Code

The following are entitled to an insurance allowance, when their loss of employment is involuntary or assimilated to an involuntary loss of employment or in the event of termination by mutual agreement of their employment relationship with their employer, and when they meet the conditions of age and previous activity, under the conditions set out in articles L. 5422-2 and L. 5422-3:

1° Civil servants and non-civil servants of the State and its public administrative establishments, permanent employees of local authorities and statutory employees of other public administrative establishments, as well as members of the armed forces ;

2° Non-statutory employees of local authorities and non-statutory employees of public administrative establishments other than those of the State and those mentioned in 4°, as well as non-statutory employees of public interest groups;

3° Employees of companies listed in the national register of companies in which the State has a majority shareholding, employees of public industrial and commercial establishments of local authorities, or of semi-public companies in which these authorities have a majority shareholding;

4° Non-statutory employees of chambers of trade and chambers of agriculture, as well as employees of establishments and services of agricultural utility of these chambers;

4° bis Staff of chambers of commerce and industry;

5° Civil servants of France Télécom placed outside the active status of their corps in order to carry out duties either in the company, in application of the fifth paragraph of article 29 of law no. 90-568 of 2 July 1990 relating to the organisation of the public postal and telecommunications service, or in one of its subsidiaries;

6° Employees of companies in the electricity and gas industries who are subject to the national status of electricity and gas industry personnel;

7° In the event that the French State no longer holds a majority stake in La Poste, employees of the public limited company La Poste.

Article L5424-1

Ont droit à une allocation d’assurance, lorsque leur privation d’emploi est involontaire ou assimilée à une privation involontaire ou en cas de cessation d’un commun accord de leur relation de travail avec leur employeur, et lorsqu’ils satisfont à des conditions d’âge et d’activité antérieure, dans les conditions prévues aux articles L. 5422-2 et L. 5422-3 :

1° Les agents fonctionnaires et non fonctionnaires de l’Etat et de ses établissements publics administratifs, les agents titulaires des collectivités territoriales ainsi que les agents statutaires des autres établissements publics administratifs ainsi que les militaires ;

2° Les agents non titulaires des collectivités territoriales et les agents non statutaires des établissements publics administratifs autres que ceux de l’Etat et ceux mentionnés au 4° ainsi que les agents non statutaires des groupements d’intérêt public ;

3° Les salariés des entreprises inscrites au répertoire national des entreprises contrôlées majoritairement par l’Etat, les salariés relevant soit des établissements publics à caractère industriel et commercial des collectivités territoriales, soit des sociétés d’économie mixte dans lesquelles ces collectivités ont une participation majoritaire ;

4° Les salariés non statutaires des chambres de métiers, des chambres d’agriculture, ainsi que les salariés des établissements et services d’utilité agricole de ces chambres ;

4° bis Les personnels des chambres de commerce et d’industrie ;

5° Les fonctionnaires de France Télécom placés hors de la position d’activité dans leurs corps en vue d’assurer des fonctions soit dans l’entreprise, en application du cinquième alinéa de l’article 29 de la loi n° 90-568 du 2 juillet 1990 relative à l’organisation du service public de la poste et des télécommunications, soit dans l’une de ses filiales ;

6° Les salariés des entreprises de la branche professionnelle des industries électriques et gazières soumis au statut national du personnel des industries électriques et gazières ;

7° Dans le cas où l’Etat ne détiendrait plus la majorité du capital de La Poste, les personnels de la société anonyme La Poste.
