Article L5424-27 of the French Labour Code

The measures for applying this section, in particular the conditions of resources, previous length of activity and previous income from activity as well as the criteria for assessing and certifying the non-viable nature of the activity to which entitlement to the allowance for self-employed workers is subject, are laid down by decree in the Conseil d’Etat. However :

1° The lump-sum amount of the allowance and the period for which it is granted are set by decree. If this lump sum is higher than the average monthly amount of previous earned income received over the previous period of activity on which entitlement to the allowance for self-employed workers is conditional, the allowance paid monthly is reduced by the same amount, without being able to be less than an amount set by decree;

2° The implementing measures relating to the coordination of the allowance for self-employed workers with the insurance allowance are set by the agreements mentioned in article L. 5422-20.

Les mesures d’application de la présente section, notamment les conditions de ressources, de durée antérieure d’activité et de revenus antérieurs d’activité ainsi que les critères d’appréciation et les modalités d’attestation du caractère non viable de l’activité auxquels est subordonné le droit à l’allocation des travailleurs indépendants sont fixées par décret en Conseil d’Etat. Toutefois :

1° Le montant forfaitaire de l’allocation et sa durée d’attribution sont fixés par décret. Si ce montant forfaitaire est supérieur au montant moyen mensuel des revenus d’activité antérieurs perçus sur la durée antérieure d’activité à laquelle est subordonné le droit à l’allocation des travailleurs indépendants, l’allocation versée mensuellement est réduite d’autant, sans pouvoir être inférieure à un montant fixé par décret ;

2° Les mesures d’application relatives à la coordination de l’allocation des travailleurs indépendants avec l’allocation d’assurance sont fixées par les accords mentionnés à l’article L. 5422-20.
