Article L5426-5 of the French Labour Code

Without prejudice to actions for recovery of unduly paid allowances and criminal proceedings, inaccuracy or incompleteness, when deliberate, in the declarations made for the benefit of allowances for workers deprived of employment as well as failure to declare a change in the situation justifying this benefit, which have resulted in undue payments, may be sanctioned by a penalty imposed by Pôle emploi.

The amount of the penalty may not exceed €3,000.

Sans préjudice des actions en récupération des allocations indûment versées et des poursuites pénales, l’inexactitude ou le caractère incomplet, lorsqu’ils sont délibérés, des déclarations faites pour le bénéfice des allocations d’aide aux travailleurs privés d’emploi ainsi que l’absence de déclaration d’un changement dans la situation justifiant ce bénéfice, ayant abouti à des versements indus, peuvent être sanctionnés par une pénalité prononcée par Pôle emploi.

Le montant de la pénalité ne peut excéder 3 000 euros.
