Article L5426-9 of the French Labour Code

A decree of the Conseil d’Etat shall determine the terms and conditions for the application of this chapter, in particular :

1° The conditions under which enforcement officers have access, in order to carry out their duties, to information held by the social security and tax authorities;

2° The conditions under which and the duration for which replacement income may be withdrawn pursuant to the first paragraph of Article L. 5426-2;

3° The conditions under which Pôle emploi recovers undue benefits pursuant to Articles L. 5426-8-1 to L. 5426-8-3 as well as the portion of the monthly instalments referred to in the same Article L. 5426-8-1;

4° The conditions under which Pôle emploi imposes and recovers the penalty provided for in Article L. 5426-5.

Article L5426-9

Un décret en Conseil d’Etat détermine les modalités d’application du présent chapitre, notamment :

1° Les conditions dans lesquelles les agents chargés du contrôle ont accès, pour l’exercice de leur mission, aux renseignements détenus par les administrations sociales et fiscales ;

2° Les conditions dans lesquelles et la durée pendant laquelle le revenu de remplacement peut être supprimé en application du premier alinéa de l’article L. 5426-2 ;

3° Les conditions dans lesquelles Pôle emploi procède à la répétition des prestations indues en application des articles L. 5426-8-1 à L. 5426-8-3 ainsi que la part des échéances mensuelles mentionnée au même article L. 5426-8-1 ;

4° Les conditions dans lesquelles Pôle emploi prononce et recouvre la pénalité prévue à l’article L. 5426-5.
