Article L5442-9 of the French Public Health Code

The following is punishable by two years’ imprisonment and a fine of 30,000 euros for the legal representative of a group referred to in article L. 5143-6 :

1° Purchasing, holding or supplying veterinary medicinal products to members of the group without the group having been approved for this purpose by the administrative authority;

2° Purchasing, holding or supplying veterinary medicinal products containing substances that are subject to special obligat ions withi n the meaning of article L. 5144-1 to members of the group without fulfilling the conditions set out in the second paragraph of article L. 5143-6; 3° Purchasing, holding or supplying veterinary medicinal products to members of the group without the supervision of a veterinarian or a pharmacist. 5144-1 without fulfilling the conditions laid down in the second paragraph of article L. 5143-6;

3° Purchasing, holding or supplying to members of the group veterinary medicinal products without the supervision of a veterinarian or pharmacist effectively participating in the technical management of the group.

Article L5442-9

Est puni de deux ans d’emprisonnement et de 30 000 euros d’amende le fait pour le représentant légal d’un groupement mentionné à l’article L. 5143-6 :

1° D’acheter, détenir ou délivrer aux membres du groupement des médicaments vétérinaires sans que le groupement ait été agréé à cet effet par l’autorité administrative ;

2° D’acheter, détenir ou délivrer aux membres du groupement des médicaments vétérinaires contenant des substances faisant l’objet d’obligations particulières au sens de l’article L. 5144-1 sans remplir les conditions prévues au second alinéa de l’article L. 5143-6 ;

3° D’acheter, détenir ou délivrer aux membres du groupement des médicaments vétérinaires sans le contrôle d’un vétérinaire ou d’un pharmacien participant effectivement à la direction technique du groupement.
