Article L5462-2 of the French Public Health Code

I.-If the manufacturer of a device referred to in Article 1 of Regulation (EU) 2017/746 of the European Parliament and of the Council of 5 April 2017 or, where applicable, its authorised representative, having become aware of a serious incident occurring on French territory, concerning this device, fails to notify the National Agency for the Safety of Medicines and Health Products in accordance with the procedures and deadlines laid down in Article 82 of this Regulation, it shall be punishable by two years’ imprisonment and a fine of €150,000.

II.-If the manufacturer of a device referred to in Article 1 of Regulation (EU) 2017/746, made available on French territory, fails to immediately notify the National Agency for the Safety of Medicines and Health Products in accordance with the procedures and deadlines laid down in Article 82 of this Regulation, it shall be punishable by two years’ imprisonment and a fine of €150,000. II.Failure by the manufacturer of a device referred to in Article 1 of Regulation (EU) 2017/746, made available on French territory, to immediately inform the Agence nationale de sécurité du médicament et des produits de santé that this device presents a serious risk, in disregard of the second subparagraph of Article 10(11) of the aforementioned Regulation, is punishable by two years’ imprisonment and a fine of €150,000.

III. -Failure by the manufacturer of a device referred to in Article 1 of Regulation (EU) 2017/746 or, where applicable, its authorised representative, to notify any corrective safety measure relating to a device made available on French territory, or any corrective safety measure taken in a third country concerning a device that is lawfully made available on French territory, under the conditions provided for in paragraph 8 of Article 82 of this Regulation, is punishable by two years’ imprisonment and a fine of 150,000 euros.

I.-Le fait, pour le fabricant d’un dispositif mentionné à l’article premier du règlement (UE) 2017/746 du Parlement européen et du Conseil du 5 avril 2017 ou, le cas échéant, pour son mandataire, ayant eu connaissance d’un incident grave survenu sur le territoire français, concernant ce dispositif, de s’abstenir de le notifier à l’Agence nationale de sécurité du médicament et des produits de santé selon les modalités et les délais prévus à l’article 82 de ce règlement est puni de deux ans d’emprisonnement et de 150 000 euros d’amende.

II.-Le fait, pour le fabricant d’un dispositif mentionné à l’article premier du règlement (UE) 2017/746, mis à disposition sur le territoire français, de s’abstenir d’informer immédiatement l’Agence nationale de sécurité du médicament et des produits de santé que ce dispositif présente un risque grave, en méconnaissance du deuxième alinéa du paragraphe 11 de l’article 10 du règlement précité, est puni de deux ans d’emprisonnement et de 150 000 euros d’amende.

III.-Le fait, pour le fabricant d’un dispositif mentionné à l’article premier du règlement (UE) 2017/746 ou, le cas échéant, pour son mandataire, de ne pas notifier toute mesure corrective de sécurité relative à un dispositif mis à disposition sur le territoire français, ou toute mesure corrective de sécurité prise dans un pays tiers concernant un dispositif qui est légalement mis à disposition sur le territoire français, dans les conditions prévues au paragraphe 8 de l’article 82 de ce règlement est puni de deux ans d’emprisonnement et de 150 000 euros d’amende.
