Article L5463-1 of the French Public Health Code

In addition to the officers and agents of the judicial police acting in accordance with the provisions of the Code of Criminal Procedure, the agents mentioned in article L. 511-3 and in 1° and 2° of I of article L. 511-22 of the Consumer Code and the doctors appointed by the Director General of the Regional Health Agency are authorised to investigate and record breaches of the provisions of article L. 5232-1 and the regulatory texts adopted for their application under the conditions set out in I of article L. 511-22 of the Consumer Code.

Penalties for breaches of the provisions of the same article are set by decree in the Conseil d’Etat.

Outre les officiers et agents de police judiciaire agissant conformément aux dispositions du code de procédure pénale, les agents mentionnés à l’article L. 511-3 et aux 1° et 2° du I de l’article L. 511-22 du code de la consommation et les médecins désignés par le directeur général de l’agence régionale de santé sont habilités à rechercher et à constater les infractions aux dispositions de l’article L. 5232-1 et des textes réglementaires pris pour leur application dans les conditions prévues au I de l’article L. 511-22 du code de la consommation.

Les sanctions en cas d’infractions aux dispositions du même article sont fixées par décret en Conseil d’Etat.
