For the purposes of this chapter, the notion of business relationship means the professional or commercial relationship with the customer and includes, where applicable, the beneficial owner. In the case of life insurance and capitalisation contracts, the business relationship includes the beneficiary of the contract and, where applicable, the beneficial owner of the beneficiary of the contract referred to in III of Article L. 561-5.
A business relationship is established when a person referred to in Article L. 561-2 enters into a professional or commercial relationship which, at the time contact is established, is expected to last for a certain period of time. The business relationship may be provided for by a contract under which several successive operations will be carried out between the contracting parties or which creates ongoing obligations for them. A business relationship is also established when, in the absence of such a contract, a customer regularly benefits from the intervention of one of the above-mentioned persons for the performance of several transactions or a transaction of a continuous nature or, in the case of the persons mentioned in 12° and 12° bis of Article L. 561-2, for the performance of a statutory mission.
In the case of the persons referred to in 18° of Article L. 561-2, the concept of a business relationship means the relationship that is established when lawyers deposit funds, bills or securities on behalf of their clients, pursuant to the provisions of 9° of Article 53 of Law No. 71-1130 of 31 December 1971.
