Article L561-30-2 of the French Monetary and Financial Code

I. – When, on the basis of a report made in accordance with Article L. 561-15, the department referred to in Article L. 561-23 refers the matter to the Public Prosecutor, it shall inform the person referred to in Article L. 561-2 who made the report, in accordance with the procedures laid down by decree.

When the report has been forwarded to it by the President of the Bar Association of the Conseil d’Etat and the Cour de Cassation or the President of the Bar Association, pursuant to Article L. 561-17, the department shall inform these authorities that the report has been forwarded to the Public Prosecutor.

The procedures for this information shall be laid down by decree.

II. – The department referred to in Article L. 561-23 may, if circumstances so require, inform persons who have sent it information pursuant to the first paragraph of Article L. 561-27 that it has referred the matter to the public prosecutor on the basis of this information.

I. – Lorsque, sur le fondement d’une déclaration faite conformément à l’article L. 561-15, le service mentionné à l’article L. 561-23 saisit le procureur de la République, il en informe, selon des modalités fixées par décret, la personne mentionnée à l’article L. 561-2 qui a effectué la déclaration.

Lorsque la déclaration lui a été transmise par le président de l’ordre des avocats au Conseil d’Etat et à la Cour de cassation ou le bâtonnier de l’ordre des avocats, en application de l’article L. 561-17, le service informe ces autorités de la transmission de la déclaration au procureur de la République.

Les modalités de cette information sont fixées par décret.

II. – Le service mentionné à l’article L. 561-23 peut, si les circonstances l’exigent, informer les personnes qui lui ont transmis des informations en application du premier alinéa de l’article L. 561-27 qu’il a saisi le procureur de la République sur la base de ces informations.
