In addition to the application of article L. 561-30-1 and article 40 of the Code of Criminal Procedure, the department is authorised to pass on information it holds to the judicial authorities and criminal investigation departments, provided that it relates to their duties.
It may also transmit information it holds to the services mentioned in articles L. 811-2 and L. 811-4 of the Internal Security Code, provided that this information is related to the purpose(s) pursued by these services as mentioned in article L. 811-3 of the same code.
It may also pass on to the tax authorities, which may use it to carry out its duties, information on facts likely to fall within the scope of the offence defined in Article 1741 of the General Tax Code or the laundering of the proceeds of this offence.
For the performance of their respective duties, the department may also transmit information :
1° To the financial courts, through their public prosecutors ;
2° To the High Authority for the Transparency of Public Life ;
3° To the Autorité de contrôle prudentiel et de résolution ;
4° The Autorité des marchés financiers;
5° The French Anti-Corruption Agency;
6° The Customs Administration;
6° bis Caisse des dépôts et consignations, as part of its anti-fraud activities;
6° ter To the Services and Payment Agency;
7° State departments responsible for preparing and implementing a measure freezing or prohibiting the movement or transfer of funds, financial instruments and economic resources;
8° State departments responsible for public policy relating to the protection and promotion of the nation’s economic, industrial and scientific interests;
9° To government departments responsible for competition, consumer affairs and fraud control;
10° The police department responsible for controlling and monitoring racing and gaming;
11° The bodies mentioned in article L. 114-12 of the Social Security Code;
12° To the officials and agents mentioned in article L. 222-9 of the Energy Code.
Transmissions made in application of this article do not mention the origin of the information.
The recipients of these transmissions shall inform the department referred to in Article L. 561-23 of the use they make of them and of the results of the actions undertaken on the basis of these transmissions.
