Article L561-47-1 of the French Monetary and Financial Code

The persons referred to in Article L. 561-2 and, insofar as this is part of the normal exercise of their controls, the authorities referred to in I of Article L. 561-36, shall report to the Registrar of the Commercial Court any discrepancy they observe between the information recorded in the register of beneficial owners referred to in Article L. 561-46 and the information on beneficial owners available to them, including the failure to record such information.

In such cases, the Registrar shall invite the registered company or entity to regularise its file. If the company or entity fails to comply with this request within one month, the Registrar shall refer the matter to the President of the Court.

Les personnes mentionnées à l’article L. 561-2 et, dans la mesure où cela s’inscrit dans l’exercice normal de leurs contrôles, les autorités mentionnées au I de l’article L. 561-36, signalent au greffier du tribunal de commerce toute divergence qu’elles constatent entre les informations inscrites dans le registre des bénéficiaires effectifs mentionné à l’article L. 561-46 et les informations sur les bénéficiaires effectifs dont elles disposent, y compris l’absence d’enregistrement de ces informations.

Le greffier invite dans ces cas la société ou l’entité immatriculée à régulariser leur dossier. Faute pour la société ou l’entité de déférer à cette invitation dans le délai d’un mois à compter de cette dernière, le greffier saisit le président du tribunal.
