Article L573-9 of the French Monetary and Financial Code

The following are punishable by the penalties laid down in Article 313-1 of the Criminal Code:

1° Any person carrying on the business of financial investment advice as defined in article L. 541-1 without meeting the conditions laid down in articles L. 541-2 to L. 541-5 ;

2° Repealed.

3° The fact, for any person engaging in the activity of financial investment advice, of receiving funds from their clients in breach of the prohibition set out in article L. 541-6.

Article L573-9

Est puni des peines prévues à l’article 313-1 du code pénal :

1° Le fait, pour toute personne, d’exercer l’activité de conseil en investissements financiers définie à l’article L. 541-1 sans remplir les conditions prévues par les articles L. 541-2 à L. 541-5 ;

2° Abrogé.

3° Le fait, pour toute personne se livrant à l’activité de conseil en investissements financiers, de recevoir de ses clients des fonds en violation de l’interdiction prévue à l’article L. 541-6.
