Failure to provide the persons referred to in Article L. 561-2, as part of the due diligence measures provided for in Section 3 of Chapter I of Title VI, or failure to declare to the Trade and Companies Register the information relating to beneficial owners required pursuant to the first paragraph of Article L. 561-46, or failure to declare information that is inaccurate or incomplete, shall be punishable by six months’ imprisonment and a fine of 7,500 euros.
Natural persons found guilty of the offence provided for in the first paragraph are also liable to the penalties of a management ban provided for in Article 131-27 of the Criminal Code and partial deprivation of civil and civic rights provided for in 2° of Article 131-26 of the same Code.
Legal entities declared criminally liable, under the conditions provided for by article 121-2 of the French Criminal Code, for the offence provided for in the first paragraph shall incur, in addition to the fine provided for by article 131-38 of the French Criminal Code, the penalties provided for in 1°, 3°, 4°, 5°, 6°, 7° and 9° of article 131-39 of the same Code.
