Article L595-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in French Polynesia:
1° With the exception of Articles L. 511-7, L. 512-2, L. 520-1, L. 521-14, L. 531-26 to L. 531-28 and L. 561-3 the words: “in France” are replaced by the words: “in French Polynesia”;
2° With the exception of the reference to the obligation to leave French territory, the words: “on French territory” are replaced by the words: “in French Polynesia” and the words: “French territory” are replaced by the words: “French Polynesia”;
3° In Article L. 521-1, the words : “and shall, under conditions laid down by decree in the Council of State, determine the State responsible pursuant to Regulation (EU) No 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person, or pursuant to commitments identical to those provided for in the same Regulation” are deleted;
4° In Article L. 531-10:
a) In the second paragraph, the words: “information on the applicant’s vulnerability sent to it pursuant to Article L. 522-4 and” are deleted;
b) In the third paragraph, the words: “as having special reception needs pursuant to Chapter II of Title II, or” are deleted;
5° 1° of Article L. 531-27 is not applicable;
6° The last paragraph of Article L. 531-41 a is deleted;
7° In the first paragraph of Article L. 561-4, the words: “the first paragraph of” are deleted;
8° In Article L. 561-14, the words: “benefits from personalised support for access to employment and housing” are replaced by the words: “may benefit from personalised support for access to employment in the form of a professional skills assessment”;
9° In Article L. 561-16, references to the Labour Code, the Social Security Code, the Social Action and Family Code and the Construction and Housing Code are replaced by references to locally applicable provisions.

Pour l’application du présent livre en Polynésie française :
1° A l’exception des articles L. 511-7, L. 512-2, L. 520-1, L. 521-14, L. 531-26 à L. 531-28 et L. 561-3 les mots : ” en France ” sont remplacés par les mots : ” en Polynésie française ” ;
2° A l’exception de la référence à l’obligation de quitter le territoire français, les mots : ” sur le territoire français ” sont remplacés par les mots : ” en Polynésie française ” et les mots : ” le territoire français ” sont remplacés par les mots : ” la Polynésie française ” ;
3° A l’article L. 521-1, les mots : ” et procède, dans des conditions fixées par décret en Conseil d’Etat, à la détermination de l’Etat responsable en application du règlement (UE) n° 604/2013 du Parlement européen et du Conseil, du 26 juin 2013, établissant les critères et mécanismes de détermination de l’Etat membre responsable de l’examen d’une demande de protection internationale introduite dans l’un des Etats membres par un ressortissant de pays tiers ou un apatride, ou en application d’engagements identiques à ceux prévus par le même règlement ” sont supprimés ;
4° A l’article L. 531-10 :
a) Au deuxième alinéa, les mots : ” des informations sur la vulnérabilité du demandeur qui lui sont transmises en application de l’article L. 522-4 et ” sont supprimés ;
b) Au troisième alinéa, les mots : ” comme ayant des besoins particuliers en matière d’accueil en application du chapitre II du titre II, ou ” sont supprimés ;
5° Le 1° de l’article L. 531-27 n’est pas applicable ;
6° Le dernier alinéa de l’article L. 531-41 a est supprimé ;
7° Au premier alinéa de l’article L. 561-4, les mots : ” le premier alinéa de ” sont supprimés ” ;
8° A l’article L. 561-14, les mots : ” bénéficie d’un accompagnement personnalisé pour l’accès à l’emploi et au logement ” sont remplacés par les mots : ” peut bénéficier d’un accompagnement personnalisé pour l’accès à l’emploi sous forme d’un bilan de compétences professionnelles ” ;
9° A l’article L. 561-16, les références au code du travail, au code de la sécurité sociale, au code de l’action sociale et des familles et au code de la construction et de l’habitation sont remplacées par les références aux dispositions applicables localement.
