Article L611-2 of the French Monetary and Financial Code

In the event of failure to comply with the instructions issued by the Minister for the application of the provisions of 1 of Article L. 611-1 and without prejudice to the provisions of Article L. 233-14 of the Commercial Code, the public prosecutor, the Autorité de contrôle prudentiel et de résolution or any shareholder may ask the court to suspend the exercise of the voting rights attached to shares in credit institutions or financial institutions within the meaning of Article L. 511-21 held directly or indirectly in an irregular manner, until the situation has been rectified.

En cas de manquement aux prescriptions édictées par le ministre pour l’application des dispositions du 1 de l’article L. 611-1 et sans préjudice des dispositions de l’article L. 233-14 du code de commerce, le procureur de la République, l’Autorité de contrôle prudentiel et de résolution ou tout actionnaire peut demander au juge de suspendre, jusqu’à régularisation de la situation, l’exercice des droits de vote attachés aux actions ou parts sociales d’établissements de crédit ou d’établissements financiers au sens de l’article L. 511-21 détenues irrégulièrement, directement ou indirectement.
