Article L611-3 of the French Intellectual Property Code

Any owner of an invention patent having effect in France and relating to a medicinal product, a process for obtaining a medicinal product, a product necessary for obtaining such a medicinal product or a process for manufacturing such a product may, where these are used for the production of a pharmaceutical speciality which is the subject of a marketing authorisation in accordance with the articles L. 601 or L. 617-1 of the Public Health Code, and from the date of its issue, obtain, in the forms and conditions laid down by this book and specified by decree in the Conseil d’Etat, a supplementary protection certificate for those parts of the patent corresponding to this authorisation.

Tout propriétaire d’un brevet d’invention produisant ses effets en France et ayant pour objet un médicament, un procédé d’obtention d’un médicament, un produit nécessaire à l’obtention de ce médicament ou un procédé de fabrication d’un tel produit peut, lorsque ceux-ci sont utilisés pour la réalisation d’une spécialité pharmaceutique faisant l’objet d’une autorisation de mise sur le marché conformément aux articles L. 601 ou L. 617-1 du code de la santé publique, et à compter de sa délivrance, obtenir, dans les formes et conditions fixées par le présent livre et précisées par décret en Conseil d’Etat, un certificat complémentaire de protection pour celles des parties du brevet correspondant à cette autorisation.
