I.-Ministerial professional advisory committees, at least half of which are made up of representatives of representative employee trade union organisations at national and cross-industry level and representative employer trade union organisations at national and cross-industry level or at national and cross-industry level, may be set up to examine proposals to create, revise or abolish vocational diplomas and qualifications and their reference systems, with the exception of higher education diplomas governed by articles L. 613-1, L. 641-4 and L. 641-5 of the Education Code. The composition, organisational rules and operating rules of these committees are set by decree in the Conseil d’Etat.
Plans to create, revise or abolish vocational higher education qualifications governed by the same articles L. 613-1, L. 641-4 and L. 641-5 shall be the subject of specific consultation, in accordance with procedures laid down by regulation, with representative employee trade union organisations at national and cross-industry level and representative employers’ professional organisations at national and cross-industry level or at national and cross-industry level.
II – The creation, revision or deletion of vocational diplomas and qualifications and their reference systems, with the exception of the procedures for implementing the assessment of skills and knowledge with a view to the award of these diplomas and qualifications, is decided after receiving the assent of the ministerial professional advisory committees.
When the decision concerns a diploma or professional qualification required for the practice of a profession pursuant to an international standard or a legislative or regulatory provision, the competent ministerial professional advisory committee will issue a simple opinion.
