Article L613-2-1 of the French Intellectual Property Code

The scope of a claim covering a gene sequence is limited to the part of that sequence directly related to the specific function concretely set out in the description.

The rights created by the grant of a patent including a gene sequence may not be invoked against a subsequent claim covering the same sequence if that claim itself satisfies the conditions of Article L. 611-18 and that it sets out another specific application of this sequence.

La portée d’une revendication couvrant une séquence génique est limitée à la partie de cette séquence directement liée à la fonction spécifique concrètement exposée dans la description.

Les droits créés par la délivrance d’un brevet incluant une séquence génique ne peuvent être invoqués à l’encontre d’une revendication ultérieure portant sur la même séquence si cette revendication satisfait elle-même aux conditions de l’article L. 611-18 et qu’elle expose une autre application particulière de cette séquence.
