Article L614-16-1 of the French Intellectual Property Code

Unitary effect may be conferred on a European patent under the conditions laid down in the first paragraph of Article 3 of Regulation (EU) No 1257/2012 of 17 December 2012.

The European patent with unitary effect takes effect in France on the day of publication of the mention of the grant of the European patent in the European Patent Bulletin. From that date, the European patent is deemed not to have taken effect in France as a national patent.

Un effet unitaire peut être conféré à un brevet européen dans les conditions prévues au premier paragraphe de l’article 3 du règlement (UE) n° 1257/2012 du 17 décembre 2012.


Le brevet européen à effet unitaire prend effet en France le jour de la publication de la mention de la délivrance du brevet européen dans le bulletin européen des brevets. A compter de ce jour, le brevet européen est réputé n’avoir pas pris effet en France en tant que brevet national.
