Article L614-16-4 of the French Intellectual Property Code

A European patent with unitary effect and a French patent application or a French patent with the same filing date or the same priority date, covering the same invention and belonging to the same inventor or his successor in title, may not, in respect of the common parts, be the subject independently of each other of a transfer, pledge, hypothecation or grant of exploitation rights, on pain of invalidity.

As an exception to Article L. 613-9, the transfer or amendment of the rights attached to the French patent application or to the French patent shall be enforceable against third parties by its entry in the national patent register only to the extent that the same transfer or amendment of the rights attached to the European patent with unitary effect has been entered in the register of the unitary protection conferred by a patent.

Un brevet européen à effet unitaire et une demande de brevet français ou un brevet français ayant la même date de dépôt ou la même date de priorité, couvrant la même invention et appartenant au même inventeur ou à son ayant cause, ne peuvent, pour les parties communes, faire l’objet indépendamment l’une de l’autre d’un transfert, gage, nantissement ou d’une concession de droits d’exploitation, à peine de nullité.


Par dérogation à l’article L. 613-9, le transfert ou la modification des droits attachés à la demande de brevet français ou au brevet français n’est rendu opposable aux tiers par son inscription au registre national des brevets que dans la mesure où le même transfert ou la même modification des droits attachés au brevet européen à effet unitaire a été inscrit au registre de la protection unitaire conférée par un brevet.
