Article L614-20 of the French Intellectual Property Code

Inventions that are the subject of international applications filed with the National Institute of Industrial Property may not be disclosed and freely exploited until authorisation has been granted to do so.

During this period, the applications may not be made public; no true copies of the application may be issued unless authorised.

The authorisations provided for in the first and second paragraphs of this article are granted by the Minister responsible for industrial property on the advice of the Minister of Defence.

The authorisation provided for in the first paragraph may be granted at any time. Subject to the provisions of the first paragraph of Article L. 614-21, it is acquired ipso jure at the end of a period of five months from the filing of the application or, where a priority has been claimed, at the end of a period of thirteen months from the priority date.

Les inventions faisant l’objet de demandes internationales déposées à l’Institut national de la propriété industrielle ne peuvent être divulguées et exploitées librement aussi longtemps qu’une autorisation n’a été accordée à cet effet.

Pendant cette période, les demandes ne peuvent être rendues publiques ; aucune copie conforme de la demande ne peut être délivrée, sauf autorisation.

Les autorisations prévues aux premier et deuxième alinéas du présent article sont accordées par le ministre chargé de la propriété industrielle sur avis du ministre de la défense.

L’autorisation prévue au premier alinéa peut être accordée à tout moment. Sous réserve des dispositions du premier alinéa de l’article L. 614-21, elle est acquise de plein droit au terme d’un délai de cinq mois à compter du dépôt de la demande ou, lorsqu’une priorité a été revendiquée, au terme d’un délai de treize mois à compter de la date de priorité.
