Article L614-34 of the French Intellectual Property Code

I. – Where detention, as provided for by European Union regulations and relating to goods suspected of infringing a patent or a supplementary exploitation certificate, is implemented before an application by the owner of a patent or a supplementary protection certificate attached to a patent or by a person entitled to exploit the patented invention or the subject of the supplementary exploitation certificate has been lodged or accepted, customs officials may, by way of derogation from Article 59 bis of the Customs Code, inform this owner or beneficiary of the exclusive exploitation right of the implementation of this measure. They may also provide information on the quantity and nature of the goods.

When the detention, provided for by European Union regulations and relating to goods suspected of infringing a patent or a supplementary exploitation certificate, is implemented after a request from the owner of a patent or a supplementary protection certificate attached to a patent or from a person entitled to exploit the patented invention or the subject of the supplementary exploitation certificate has been accepted, customs officers may also communicate to this owner or this person entitled the information provided for by these regulations, necessary to determine whether there has been an infringement of his right.

II. – The costs generated by the implementation of the withholding referred to in I shall be borne by the owner of the patent or supplementary protection certificate attached to a patent or by the person entitled to exploit the patented invention or the subject of the supplementary exploitation certificate.

I. ― Lorsque la retenue, prévue par la réglementation de l’Union européenne et portant sur des marchandises soupçonnées de constituer une contrefaçon d’un brevet ou d’un certificat complémentaire d’exploitation, est mise en œuvre avant qu’une demande du propriétaire d’un brevet ou d’un certificat complémentaire de protection rattaché à un brevet ou d’une personne habilitée à exploiter l’invention brevetée ou objet du certificat complémentaire d’exploitation ait été déposée ou acceptée, les agents des douanes peuvent, par dérogation à l’article 59 bis du code des douanes, informer ce propriétaire ou ce bénéficiaire du droit exclusif d’exploitation de la mise en œuvre de cette mesure. Ils peuvent également lui communiquer des informations portant sur la quantité des marchandises et leur nature.

Lorsque la retenue, prévue par la réglementation de l’Union européenne et portant sur des marchandises soupçonnées de constituer une contrefaçon d’un brevet ou d’un certificat complémentaire d’exploitation, est mise en œuvre après qu’une demande du propriétaire d’un brevet ou d’un certificat complémentaire de protection rattaché à un brevet ou d’une personne habilitée à exploiter l’invention brevetée ou objet du certificat complémentaire d’exploitation a été acceptée, les agents des douanes peuvent également communiquer à ce propriétaire ou à cette personne habilitée les informations prévues par cette réglementation, nécessaires pour déterminer s’il y a eu violation de son droit.

II. ― Les frais générés par la mise en œuvre de la retenue mentionnée au I sont à la charge du propriétaire du brevet ou du certificat complémentaire de protection rattaché à un brevet ou de la personne habilitée à exploiter l’invention brevetée ou objet du certificat complémentaire d’exploitation.
