Article L614-35 of the French Intellectual Property Code

During the withholding period referred to in Article L. 614-32 and in the second paragraph of I of article L. 614-34, the owner of the patent or of the supplementary protection certificate attached to a patent or the person entitled to exploit the patented invention or the subject of the supplementary exploitation certificate may, at his request or at the request of the customs administration, inspect the goods detained.

When inspecting the detained goods, the customs administration may take samples.

Pendant le délai de la retenue mentionnée à l’article L. 614-32 et au second alinéa du I de l’article L. 614-34, le propriétaire du brevet ou du certificat complémentaire de protection rattaché à un brevet ou la personne habilitée à exploiter l’invention brevetée ou objet du certificat complémentaire d’exploitation peut, à sa demande ou à la demande de l’administration des douanes, inspecter les marchandises retenues.

Lors du contrôle des marchandises mises en retenue, l’administration des douanes peut prélever des échantillons.
