By way of derogation from articles L. 6146-1 and L. 6146-1-1, the director and the chairman of the medical commission of a public health establishment may decide to freely organise the medical operation and the provision of care, in accordance with the establishment’s medical project approved by the management board.
This decision is taken with the approval of the medical commission of the establishment and the nursing, re-education and medico-technical care commission. The hospital’s technical committee is consulted.
As part of the derogation mentioned in the first paragraph of this article, the director and the chairman of the hospital’s medical committee jointly appoint the heads of the medical and medico-technical structures created. After consulting the establishment’s medical committee, the nursing, rehabilitation and medico-technical care committee and the establishment’s technical committee, the director shall lay down the procedures for the participation and expression of staff in the operation of these structures.
The procedures for this internal organisation, as well as its consequences for the cooperative actions in which the establishment is involved, are specified in the establishment’s internal regulations.
