Article L6148-1 of the French Public Health Code

In accordance with the provisions of article L. 3111-1 of the French General Code of Public Ownership, the properties in the public domain of public health establishments and health cooperation structures with public legal personality are inalienable and imprescriptible.

However, property belonging to this domain may be sold under the conditions set out in article L. 3112-1 of the General Code of Public Property or exchanged under the conditions set out in articles L. 3112-2 and L. 3112-3 of the same code.

The provisions of articles L. 1311-13 and L. 1311-14 of the General Local Authorities Code apply to this domain.

Article L6148-1

Conformément aux dispositions de l’article L. 3111-1 du code général de la propriété des personnes publiques, les propriétés qui relèvent du domaine public des établissements publics de santé et de structures de coopération sanitaire dotées de la personnalité morale publique sont inaliénables et imprescriptibles.

Toutefois, les propriétés qui relèvent de ce domaine peuvent être cédées dans les conditions prévues à l’article L. 3112-1 du code général de la propriété des personnes publiques ou échangées dans les conditions fixées aux articles L. 3112-2 et L. 3112-3 du même code.

Les dispositions des articles L. 1311-13 et L. 1311-14 du code général des collectivités territoriales s’appliquent à ce domaine.
