Article L6148-7-1 of the French Public Health Code

Public health establishments and health cooperation structures with public legal personality may not directly enter into leasing contracts, within the meaning of articles L. 313-7 to L. 313-10 of the French Monetary and Financial Code, the purpose of which is the construction, modification or renovation of real estate assets meeting a need specified by the public authority and intended to be made available to it or to become its property.

This prohibition does not apply to projects for which the public invitation to tender was published before 1 January 2015.

Article L6148-7-1

Les établissements publics de santé et les structures de coopération sanitaire dotées de la personnalité morale publique ne peuvent conclure directement les contrats de crédit-bail, au sens des articles L. 313-7 à L. 313-10 du code monétaire et financier qui ont pour objet la réalisation, la modification ou la rénovation d’ouvrages immobiliers répondant à un besoin précisé par la collectivité publique et destinés à être mis à sa disposition ou à devenir sa propriété.

Cette interdiction ne s’applique pas aux projets dont l’avis d’appel public à la concurrence a été publié avant le 1er janvier 2015.
