Article L6149-1 of the French Public Health Code

Notwithstanding the provisions of this Code relating to the Management Board, the Institutional Medical Committee, the Nursing, Rehabilitation and Medico-Technical Committee and the internal organisation of the institution, in particular Articles L. 6143-7-5, L. 6144-1, L. 6144-2, L. 6146-1, L. 6146-1-1 and L. 6146-9, an institution may freely organise its medical operations, care and governance in accordance with the institutional project approved by the Supervisory Board.

This freedom of organisation is decided jointly by the director and the chairman of the establishment’s medical committee, following favourable opinions from this committee and the nursing, rehabilitation and medico-technical care committee, as well as, where applicable, the establishment’s technical committee and the supervisory board.

After consulting the establishment’s medical committee, the nursing, rehabilitation and medico-technical care committee and the establishment’s technical committee, the director shall lay down the procedures for staff participation in the operation of the structures thus created and the procedures for the expression of these same staff within them.

The procedures for this internal governance and organisation shall be specified in the establishment’s internal regulations.

Article L6149-1

Par dérogation aux dispositions du présent code relatives au directoire, à la commission médicale d’établissement, à la commission des soins infirmiers, de rééducation et médico-techniques ainsi qu’à l’organisation interne de l’établissement, notamment aux articles L. 6143-7-5, L. 6144-1, L. 6144-2, L. 6146-1, L. 6146-1-1 et L. 6146-9, un établissement peut organiser librement le fonctionnement médical, les soins et la gouvernance en son sein, conformément au projet d’établissement approuvé par le conseil de surveillance.

Cette libre organisation est décidée conjointement par le directeur et le président de la commission médicale d’établissement, après avis favorables de cette commission et de la commission des soins infirmiers, de rééducation et médico-techniques ainsi que, le cas échéant, du comité technique d’établissement et du conseil de surveillance.

Le directeur prévoit, après consultation de la commission médicale d’établissement, de la commission des soins infirmiers, de rééducation et médico-techniques et du comité technique d’établissement, les modalités de participation des personnels au fonctionnement des structures ainsi créées et les modalités d’expression de ces mêmes personnels en leur sein.

Les modalités de cette gouvernance et de cette organisation internes sont précisées dans le règlement intérieur de l’établissement.
