Notwithstanding the provisions of this Code relating to the Management Board, the Institutional Medical Committee, the Nursing, Rehabilitation and Medico-Technical Committee and the internal organisation of the institution, in particular Articles L. 6143-7-5, L. 6144-1, L. 6144-2, L. 6146-1, L. 6146-1-1 and L. 6146-9, an institution may freely organise its medical operations, care and governance in accordance with the institutional project approved by the Supervisory Board.
This freedom of organisation is decided jointly by the director and the chairman of the establishment’s medical committee, following favourable opinions from this committee and the nursing, rehabilitation and medico-technical care committee, as well as, where applicable, the establishment’s technical committee and the supervisory board.
After consulting the establishment’s medical committee, the nursing, rehabilitation and medico-technical care committee and the establishment’s technical committee, the director shall lay down the procedures for staff participation in the operation of the structures thus created and the procedures for the expression of these same staff within them.
The procedures for this internal governance and organisation shall be specified in the establishment’s internal regulations.
