Article L615-4 of the French Intellectual Property Code

As an exception to the provisions of Article L. 613-1, acts prior to the date on which the patent application was made public under Article L. 612-21 or that of the notification to any third party of a certified copy of this application shall not be deemed to have infringed the rights attached to the patent.

However, between the date referred to in the preceding paragraph and that of the publication of the grant of the patent:

1° The patent is enforceable only to the extent that the claims have not been extended after the first of these dates;

2° Where the patent relates to the use of a micro-organism, it is enforceable only from the day on which the micro-organism is made available to the public.

The court hearing an infringement action on the basis of a patent application shall stay the proceedings until the patent is granted.

Par exception aux dispositions de l’article L. 613-1, les faits antérieurs à la date à laquelle la demande de brevet a été rendue publique en vertu de l’article L. 612-21 ou à celle de la notification à tout tiers d’une copie certifiée de cette demande ne sont pas considérés comme ayant porté atteinte aux droits attachés au brevet.

Toutefois, entre la date visée à l’alinéa précédent et celle de la publication de la délivrance du brevet :

1° Le brevet n’est opposable que dans la mesure où les revendications n’ont pas été étendues après la première de ces dates ;

2° Lorsque le brevet concerne l’utilisation d’un micro-organisme, il n’est opposable qu’à compter du jour où le micro-organisme est mis à la disposition du public.

Le tribunal saisi d’une action en contrefaçon sur le fondement d’une demande de brevet surseoit à statuer jusqu’à la délivrance du brevet.
