Article L621-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A decision to surrender to the competent authorities of a Member State of the European Union may be taken in the case of a foreign national holding a valid residence permit bearing the words “EU Blue Card” granted by that State, where he or she is refused the issue of the residence permit provided for in article L. 421-11 or where the residence permit bearing the words “EU Blue Card” which he or she holds expires or is withdrawn during the examination of his or her application. The conditions for application of this article shall be determined by decree in the Conseil d’Etat.

Article L621-5

Peut faire l’objet d’une décision de remise aux autorités compétentes d’un Etat membre de l’Union européenne l’étranger détenteur d’une carte de séjour portant la mention ” carte bleue européenne ” en cours de validité accordée par cet Etat, lorsque lui est refusée la délivrance de la carte de séjour prévue à l’article L. 421-11 ou bien lorsque la carte de séjour portant la mention ” carte bleue européenne ” dont il bénéficie expire ou lui est retirée durant l’examen de sa demande.
Les membres de la famille de l’étranger mentionné au premier alinéa peuvent également faire l’objet d’une décision de remise.
Les conditions d’application du présent article sont déterminées par décret en Conseil d’Etat.
